The German PV technology company Robert Bürkle has obtained a first instance judgement in its favour before the Chinese Intermediate People’s Court in Hefei, China, against the Chinese manufacturer Qinhuangdao Visual Automation Equipment Co., Ltd. (“Visual”).
The Chinese court’s ruling states that Visual’s KSL1824 laminator conflicts with rights under Bürkle’s Chinese patent CN 101314270 B, relating to the company’s multi-level, multi-daylight laminator, which is also protected by, among others, European patent EP 1 997 614 B1. The judgement, which is not yet final, prohibits Visual from manufacturing and selling or offering to sell such multi-level laminators from China and requires It to destroy infringing products and semi-finished products and the equipment and molds used to manufacture them.
In connection with the court ruling, Visual has already filed a complaint. However, Bürkle remains confident that these proceedings will be decided once again in favour of its existing patent.
